This position is responsible for providing overall leadership for Risk Management and Captive Insurance Company services and claims management to Tufts MC, its affiliates and related physician groups. Direct and supervise risk management staff in the implementation of comprehensive risk management program. Provide legal advice regarding clinical issues throughout the system.
Organizes, supervises and monitors all risk management services provided by the institutional risk management staff.
Provides legal and risk management advice and counsel to members of the medical, nursing, professional and administrative staff on matters affecting the operation of the Hospital, its patients, and its staff.
Provides case consultation to medical, nursing and other clinical professional staff regarding legal issues involving the Hospital's patients.
Coordinates litigation initiated by Tufts MC to facilitate patient care, including care and protection petitions, guardianship petitions, complaints for declaratory judgments, and civil commitments.
Provides legal and risk management consultation and advice to Hospital committees. Provides staff support, including preparation of agendas and minutes, to the Professional Standards Committee of the Board, the Credentials Committee and the Medical Board of the Hospital. Establishes and maintains multidisciplinary Risk Management Committee to review risk management matters, including serious unexpected incidents and claims.
Consults with Medical Records and other Departments regarding release of records and information in response to subpoenas, court orders, attorney requests, regulatory agency investigations and other inquiries.
Assists in the development of Hospital policies, procedures, and forms pertaining to patient care, human resources, labor and employment, and administrative matters by reviewing and recommending revisions to new or existing policies, procedures and forms to conform to legal standards and requirements.
Reviews, drafts and revises affiliation agreements and other clinically related contracts involving the hospital and its affiliates as required.
Oversees the coordination of regulatory compliance with the Patient Care Assessment Program as established by the Board of Registration in Medicine, including requirements for credentialing, incident/occurrence/event reporting, disciplinary action reporting, serious patient complaint resolution, impaired providers and continuing education.
Participates in the on-call 24-hour emergency legal and risk management consultation system on a rotating basis. Provides direction and advice to medical staff as necessary in connection with potential malpractice exposure.
Initiates investigation of incidents/events involving actual or potential injury to patients and visitors that could lead to financial loss, including professional and general liability. Ensures collection of information necessary to prepare for defense of claims. Recommends and implements loss control measures in efforts to minimize potential liability exposure.
Provides information and assistance to clinical staff in complying with federal and state law and regulations, regulatory standards and Joint Commission and NCQA requirements.
Coordinates reporting of patient care related incidents to the Department of Public Health and other regulatory agencies as required by law. Participates in the investigation and development of corrective plans. Submits required reports to state and federal agencies.
Participates in the development and maintenance of systems to ensure data storage, processing and retrieval related to actual and potential liability claims, incident and event reporting and credentialing information.
Oversees the development of systems to communicate periodically with appropriate department's information relating to legal and risk management issues, including periodic reporting relating to incidents or events, claim patterns and risk control.
Provides analysis and recommend action for resolution of cases which may represent potential liability. Assists clinical Chairmen and Department Heads in designing risk management programs within their departments and determining when physician performance data requires further evaluation by peer review committees.
Plans, develops and presents educational material and disseminates information relating to relevant legal and risk management issues to Hospital wide medical, professional, technical and administrative staff and serve as faculty for continuing education programs.
Provides legal advice and support for clinically related issues to Hospital and on-site risk managers.
Provides risk management and legal advice and support to the Hospital and its affiliated entities on legal aspects of medical and resident staff matters, including credentialing, peer review, privileging, medical staff bylaws, scope of practice, patient care and other operational issues.
Completes/performs special projects and other duties as assigned by General Counsel.
Maintains collaborative, team relationships with peers and colleagues in order to effectively contribute to the working groups achievement of goals, and to help foster a positive work environment
Performs other similar job related duties as required or directed.
Interacts and is responsive to the needs of the executive management team at Tufts MC and its Board.
Interacts and works with General Counsel.
Trains and supervises subordinate staff.
Frequently interacts with outside counsel and other lawyers who represent patients, individuals, business entities, other health care providers, and governmental and regulatory authorities. Confers with judges, court officers, patients and their representatives on patient care and treatment matters.
Excellent oral and written communication skills. Ability to relate well with others at various levels and ability to educate and train others.
Bachelor's degree required in nursing or health related field; Juris Doctorate. Member in good standing of the Massachusetts Bar.
Five to seven years progressively responsible legal/risk management experience in health care setting.
An equivalent combination of education and experience, which provides proficiency in the areas of responsibility listed above, may be substituted for the above education and experience requirements.
